Welcome to Marcon Marketplace (“Marcon Marketplace,” “we,” “us,” or “our”).
These Terms and Conditions (“Terms”) govern your access to and use of our website located at https://marconmarketplace.com and any related online services (collectively, the “Website” or “Service”). By accessing or using the Service, you agree to be bound by these Terms and by our Refund & Cancellation Policy and Privacy Policy (collectively, the “Agreements”).
Marcon Marketplace is a service of Marcon International, Inc. If you do not agree to these Terms or any of the Agreements, you may not use the Website or Service.

Marcon Marketplace is an online marketplace serving the marine industry. We allow users to:

• Post marine equipment and items for sale
• Post marine-related job opportunities
• Browse listings and job postings at no cost

Paid subscription accounts are required for users who post listings.

The Service is intended primarily for use by businesses and professionals in the marine industry. To the extent any user is an individual using the Service for personal, family, or household purposes, these Terms will be interpreted to comply with applicable consumer protection laws.

Marcon Marketplace is accessible worldwide, and we welcome users from any country. The Service is primarily designed for business and professional users in the marine industry. If you access the Service from outside the United States, you do so on your own initiative and are responsible for compliance with local laws applicable to your use of the Service and your listings.

You must be at least 18 years old to create an account or post listings on Marcon Marketplace.
By using the Service, you represent that you meet this requirement.

If you represent a business or organization, you represent and warrant that you have authority to bind that entity to these Terms and that you are using the Service for lawful commercial purposes permitted in your jurisdiction.

To post items or job listings, you must create an account and provide accurate, complete, and current information. You agree to promptly update your account information, including contact and billing information, so that it remains accurate and complete.

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account

We may send you notices about your account, including legal notices and notices of changes to these Terms, by email to the address associated with your account or by posting on the Website. It is your responsibility to monitor such communications.

We reserve the right to suspend or terminate accounts that violate these Terms.

Posting listings requires an active paid subscription account (a “Subscription”). The terms governing Subscription billing, auto‑renewal, and cancellation are described in our Refund & Cancellation Policy, which is incorporated into these Terms by this reference.

Current Plan:

• $99 per month (USD), plus any applicable taxes or duties
• Allows unlimited listings during the active billing period

Key points (summary only; see Refund & Cancellation Policy for full terms):

• Subscription fees are billed in advance on a recurring monthly basis until you cancel.
• Except as required by applicable law or expressly stated in the Refund & Cancellation Policy, payments are non-refundable, including for unused time or removed listings.
• Pricing may change with reasonable advance notice, and any changes will apply only to future billing periods. If you do not agree with a change, you may cancel before it takes effect.

Sales and Use Taxes; Marketplace Facilitator:
To the extent Marcon Marketplace is treated as a “marketplace facilitator” or similar construct under applicable tax laws, including Washington law, we may be required to collect and remit sales, use, or other transaction taxes on certain sales made through the Service. We may rely on and provide tax documentation and reporting as required by law, and you agree that we may collect such taxes in addition to Subscription fees where applicable. You remain responsible for any taxes or reporting obligations that are not our legal responsibility to collect or remit.

Taxes and International Payments:
Subscription fees are charged in U.S. dollars. Depending on your location, we may be required to collect and remit sales tax, VAT, GST, or similar transaction taxes, which will be added to your subscription fee where applicable. If we are not required to collect such taxes, you are responsible for determining and paying any taxes owed in your jurisdiction. You are also responsible for compliance with local laws governing your use of the Service, including advertising standards, employment laws, and export/import regulations.

Users who post listings or job opportunities (“User Content”) agree that:

• They own or have the legal right to post the content
• Listings are accurate, lawful, and not misleading
• Listings do not infringe on third-party rights

By posting or submitting any content (“User Content”), you grant Marcon Marketplace and Marcon International, Inc. a non‑exclusive, worldwide, royalty‑free, sublicensable license to host, store, reproduce, modify for formatting, display, distribute, and otherwise use your User Content as necessary to operate, promote, and improve the Service.

We do not undertake to screen User Content in advance, but we may remove, edit, or refuse to display any User Content at our sole discretion if we believe it violates these Terms or applicable law, or for any other lawful business reason.

You are solely responsible for ensuring that your listings and job postings comply with all applicable laws in the jurisdictions where you operate or where your listings may be viewed, including advertising standards, employment laws, anti-discrimination laws, and export control regulations.

We do not guarantee the accuracy, quality, or success of any listing or transaction.

In some cases, we may process personal information on behalf of our business clients (for example, where we manage listings or campaigns under a separate agreement). In those situations, we will act as a service provider or processor as described in that agreement, and the client’s terms with its own users will govern their relationship.

You agree not to use the Service to:

• Violate any applicable law or regulation
• Post false, fraudulent, or misleading listings
• Infringe intellectual property or privacy rights
• Upload malware, spam, or harmful code
• Harass, abuse, or exploit other users
• Collect personal information about other users in violation of our Privacy Policy or applicable data protection laws.
• Engage in any activity that interferes with or disrupts the Service or the servers and networks used to provide the Service.

We may remove content or suspend accounts at our sole discretion.

Marcon Marketplace:

• Is not a broker, employer, or agent
• Does not participate in transactions or hiring decisions
• Is not responsible for disputes between buyers, sellers, or employers

All transactions and employment arrangements occur directly between users, and you are solely responsible for evaluating and entering into any transactions or employment relationship.

You acknowledge that we do not verify the identity, qualifications, or background of users, buyers, sellers, or employers, and you should use appropriate caution and due diligence when interacting with others through the Service.

All Website content — including branding, logos, text, graphics, and software — is the property of Marcon International, Inc. or its licensors.

You may not copy, modify, distribute, or use our content for commercial purposes without written permission.

Subject to your compliance with these Terms, we grant you a limited, non‑exclusive, non‑transferable, revocable license to access and use the Service for its intended purposes.

The Website may contain links to third-party websites. We are not responsible for their content, policies, or practices. Any third‑party sites you visit from links on the Website are governed by their own terms and privacy policies, which you should review carefully. We do not endorse or assume responsibility for third‑party products or services.

We may suspend or terminate access to the Service at any time, with or without notice, if:

• These Terms are violated
• We believe your activity poses legal or operational risk

We may also terminate or suspend your access if required to comply with law, regulation, or a governmental request.

Termination or suspension of your account does not entitle you to a refund of any fees already paid, except where a refund is required by applicable law or expressly provided in the Refund & Cancellation Policy.

The Service is provided “AS IS” and “AS AVAILABLE.”

We make no guarantees that:

• Listings will result in sales or job placements
• The Website will be uninterrupted or error-free
• Content is accurate or complete

Use of the Service is at your own risk. To the fullest extent permitted by law, we disclaim all warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non‑infringement.

To the fullest extent permitted by applicable law, Marcon Marketplace, Marcon International, Inc., and their respective officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption, arising out of or in connection with your use of the Service.

In all cases, our total aggregate liability for all claims arising out of or relating to the Service or these Terms will not exceed the total amount you paid to us for the Service during the twelve (12) months immediately preceding the event giving rise to the claim, or USD fifty dollars (US $50), whichever is greater, to the extent permitted by law.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages. Where such exclusions or limitations are prohibited by applicable law, they will not apply to you, but only to the minimum extent required by law.

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, disclose, and protect personal information and explains your choices and rights regarding your information under applicable law, including, where applicable, California’s CCPA/CPRA and other state privacy laws.

California Residents (CCPA/CPRA)

If the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, “CCPA/CPRA”), applies to our processing of your personal information, you may have additional rights, including rights of access, deletion, correction, and the right to opt out of certain “sales” or “sharing” of personal information. Other State Privacy Rights
Depending on where you live, you may have additional privacy rights under state law. These rights, including how to exercise them, are described in our Privacy Policy.
The Agreements form part of these Terms. If there is a conflict between these Terms and the Refund & Cancellation Policy or Privacy Policy, the document that provides greater protection to you as required by applicable law will control for that issue.

These Terms are governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict-of-law principles. Any disputes arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Island County, Washington, and you consent to the personal jurisdiction of such courts.

International Users and Mandatory Laws
If you are located outside the United States, mandatory consumer protection or data protection laws in your jurisdiction may provide you with rights that cannot be waived or limited by contract. To the extent such mandatory laws apply to you and conflict with these Terms, those mandatory provisions will govern to the minimum extent required by law, and the remainder of these Terms will remain in full force and effect.

We may update these Terms from time to time. Material changes will be posted on the Website with an updated “Last Updated” date. If we make material changes, we will provide additional notice where required by law, which may include email notification or a prominent notice on the Website.

Continued use of the Service after changes means acceptance.
